Preliminary information
These terms of use of the Buyback Module regulate the sale process, by the private consumer, of their movable property in favor of Deemood Italia srl based in viale Giuseppe Mazzini, 4 00195 Rome. VAT number 16956851006.
Deemood Italia srl is the owner of the "Likenewiphone" trademark and manages the sales platform accessible at the site www.likenewiphone.com. Within the site referred to in the previous paragraph there is a section "Sell your Smartphone" which allows the consumer to preliminary evaluate and sell your used product to Deemood Italia srl.
Completion of the contract
The contract in question is concluded between Deemood Italia srl (buyer) and the natural person (transferor) identified through their personal details entered on the website and through the copy of the document requested when sending the goods.
The transferor makes a proposal to the buyer to sell his / her own asset better described by filling it in online on the website 2. www.likenewiphone.com.
The buyer reserves the right, at its sole discretion, to confirm whether or not the automatic offer of the module during the physical test phase of the product.
In case of correspondence, between what is described by the customer when filling in the form and the results of the tests, the buyer undertakes to confirm the evaluation of the goods made automatically with his own written proposal sent by email and considered accepted if not found negatively by and no later than 72 hours after sending the confirmation e-mail.
In the event that the valuation of the asset, quantified by the buyer during the tests, is different from that communicated automatically and accepted by the customer, the buyer will send a formal communication of the offer to the customer by attaching the test certificate (if available) and the enhancement of the asset. The proposal will be considered accepted even in the event of non-reply by the seller after 72 hours from the buyer's proposal.
Functionality of the module
The module is completely free and provides a simple evaluation of the goods as described by the consumer. The final evaluation is unquestionably up to the buyer after the physical check of the phone and the certified functionality test.
The transferor must be as precise as possible in the description of his asset in order to arrive at a truthful assessment of the asset being sold. Inaccurate or false information will invalidate the assessment which will be subject to subsequent revision.
After the evaluation of the product, the customer can freely decide whether to adhere to the offer formalized on the platform or to withdraw. If the answer is affirmative, the consumer undertakes to send the goods subject to evaluation to the buyer.
The shipment can take place via shipment managed by the transferor or, alternatively, through the issue of a prepaid label by the buyer.
The transferor undertakes to pack the goods correctly, to eliminate codes, personal accounts, and personal data from the device before shipment, to provide information on the collection / shipment of the goods.
In the event of non-compliance with the provisions referred to in the previous article, the buyer reserves the right to apply a penalty of up to 20% of the value of the asset for the work necessary to restore the conditions of the device.
Responsibility of the transferor
The transferor declares, by sending the form alone, that the telephone being sold is his property, that no legal entity can claim claims on the property and that it is not of illicit origin.
The transferor also declares that the device does not belong to any telephone company that can activate on the same block and / or pass the serial to the blacklist of telephone operators.
Final evaluation and communication
The buyer undertakes to evaluate the goods within 5 days of receipt by sending written notification of receipt and a formal evaluation proposal.
Once the sale offer has been accepted, the goods will become the property of the buyer who, within 15 working days, will proceed to issue payment at the agreed price and according to the methods chosen by the consumer during the evaluation phase. The crediting times will depend on the credit institution or managing body and will not in any way be attributable to the buyer. In the case of a sale to be regulated through “Likenewiphone Credits”, the consumer will receive a communication on his email containing the discount code to use the credits on the platform. Credits expire within 12 months of issuing the voucher.
In the event of an evaluation disagreement, the goods will remain available to the Consumer at the buyer's warehouse and must be collected no later than 5 days from the closing of the transaction with a negative outcome.
In the event of a change to the final evaluation, Deemood Italia srl undertakes to provide the transferring consumer with a detailed evaluation of the goods being sold.
Final provisions
The goods being sold will no longer be available from the moment of payment of the consideration. For this reason there is no "withdrawal" from the will to sell.
No responsibility is foreseen for the buyer in case of failure of the goods after the evaluation by the buyer.
Although not explicitly regulated, the parties agree that the transaction will be regulated according to the provisions of the civil code.
